Desert Barbell Sports Club terms and conditions
References to ‘you’, ‘your’ and ‘yours’, and after acceptance, are references to the individual completing the membership application form. By completing the form and subsequent payment, you accept these terms.
You must be aged 18 or over to register your membership. If you are under 18, your parent(s) or legal guardian must be present at time of joining.

Principle terms
1. This agreement commences once you have indicated your acceptance of the terms and conditions upon filling in the member intake form and purchasing your chosen membership.
2. Memberships are subject to management approval. Management reserves the right to reject an application for membership for any reason whatsoever, in their absolute discretion.
3. Your membership starts immediately, unless agreed otherwise. You can delay the start of your membership up to 14 days from payment date.
4. This agreement will become binding on you and us and you will be entitled to all the rights and privileges exercisable for the type of Membership chosen.
5. Membership are not transferable to any other person for any reason whatsoever.
6. The Laws of the United Arab Emirates shall govern the Terms & Conditions, without regards to conflict of laws principals.
7. All disputes shall be heard only by a court of competent jurisdiction in U.A.E.
Physical Health & Wellness of the Member
8. In accepting these Terms & Conditions the member warrants and also represents that he/she is in good health and is not knowingly incapable of engaging in either active or passive exercise. The member further warrants that such exercise would not be detrimental to their health, safety, comfort, well-being or physical condition.
9. The member will refrain from utilizing Desert Barbell Sports Club and related facilities whilst suffering from any infections or contagious illness, disease or other ailment including but not limited to open cuts, abrasions, open sores or minor infection, where there is a risk that such use may be detrimental to the health, safety, comfort or physical condition of other members.
10. Members are required to read, confirm and sign the Health Declaration Form before using the facilities. Your membership will be suspended until this is complete. It is mandatory that this is completed with a competent and authorized member of the Desert Barbell Sports Club staff.
11. Members are required to notify Desert Barbell Sports Club in case of any special conditions, ailments or medications that may affect them while performing any exercises. In some cases, we will require an NOC from your doctor to permit the member to use the facility.
Fees and charges
12. Prices are inclusive of VAT and applicable taxes. Any additional taxes resulting from the purchase of your membership is for the payment of the member.
13. Monthly memberships are purchased one month at a time with no contract period. Members may choose to automate this payment if they wish to continue this membership option indefinitely. You may cancel at any time however there is no refund or partial refunds for monthly membership payments regardless of usage. The bill for the following month will be automatically generated one month from the initial payment and if the member does not renew then the membership will be cancelled in the system.
14. Monthly memberships are rolling which means if you train in consecutive months you will be billed from when the previous contract ended. The new contract will start immidiately.
15. 3, 6 and 12 month memberships are paid upfront and are activated upon receiving full payment.
16. All memberships start from payment date and are not prorated. full payment is required in advance to activate your membership unless agreed otherwise with Club management.
17. You agree to advise us immediately if any changes occur to the member details provided.
18. All credit/debit cards’ details and personally identifiable information will NOT be stored, sold, shared, rented or leased to any third parties.
19. We will not pass any debit/credit card details or any members information to third parties.
20. We take appropriate steps to ensure data privacy and security including through various hardware and software methodologies. However, we cannot guarantee the security of any information that is disclosed online
21. Desert Barbell is not responsible for the privacy policies of websites to which it links. Please ensure you understand the terms of use and privacy policy of any external website that is not owned or managed by Desert Barbell Trading LLC.
22. You will be unaffected by any changes to membership prices during the term of your membership. We reserve the right to either continue your current membership rate or increase in line with current prices once your existing term is completed.
Cancellations and refunds
23. We have a no refund policy on monthly memberships. Once a monthly membership is purchased it cannot be refunded under any circumstances.
24. Three (3), six (6) and twelve (12) month memberships will be subject to partial refund if one of the the following conditions are met. 1) The member is unexpectedly relocated to another city for work reasons, 2) Severe medical condition or illness spanning more than 3 months or 3) Pregnancy. In these case the member can choose to pause the membership indefinitely or will be refunded prorated based on usage. Usage will be counted from initial payment date to the date of refund request. Refunds must be requested by sending an email to support@desertbarbell.co, along with supporting documents, and if approved the refund will take up to 14 working days to process.
Freezing
25. There is no freeze period for monthly memberships, unless the member suddenly comes ill or temporarily injured. The member is responsible for notifying the Club in writing at support@desertbarbell.co in the event of illness or injury.
26. Three (3), six (6) and twelve (12) month memberships can be frozen for a period of up to 30 days. This can be done twice, so long as the total freeze days do not exceed 30 days. The member is responsible for notifying the Club of intention to freeze no later than 14 days from the planned freeze date. These membership can not, under any circumstances, be frozen in the last 30 days of the membership contract.
Health & Safety
27. All members are required to sign and agree to the ‘Desert Barbell Sports Club Etiquette’ form before using the facility. This will be provided on first visit to the facility. Failure to comply will result in termination of your membership without refund or recourse.
28. Members are required to clean up the machine or area after use.
29. Members are requested to return all portable equipment to the racks provided, brush used bars with brushes provided and leave the area clean and tidy for the next member.
30. Members unsure about any equipment should consult a member of staff.
31. Desert Barbell staff are authorized to stop anyone from exercising if in their opinion the member/guest is exercising in a manner that may result in personal injury and/or injury to others, or may cause damage to the equipment or facility.
32. While every precaution is taken to maintain safety standards, all equipment and facilities are used entirely at the members or guests own risk. Any malfunction of equipment noted should be reported to a member of staff as soon as it is noticed.
33. We reserve the right to close any part of the building or withdraw equipment for conducting essential repairs or maintenance. Prior notice will be given where possible to avoid inconvenience.
34. For safety purposes kindly use plastic bottles with sports lids for drinks where allowed.
35. For safety and hygiene purposes, no eating is allowed outside of designated areas.
36. Members or guests may not use the facilities whilst under the influence of alcohol, narcotics or other mood altering substances.
37. We operate a strict no smoking policy within the facility or its immediate borders
Dress code
38. All members are required to wear proper gym attire when exercising and to dress modestly when working out. 39. We reserve the right to ask members not dressed appropriately to leave the premises. This is for the consideration of other members and your safety.
40. Members must wear closed toe shoes at all time. Flip-flops or open toed shoes are strictly not allowed in the main lifting areas of the facility.
41. Members should remain modestly and appropriately dressed at all times, including in the changing areas.
Nudity is strictly forbidden and members are requested to exercise discretion and consideration to other members in the changing rooms.
Lockers and changing rooms
42. Temporary lockers are provided for the members.
43. Members shall remove their personal belongings at the completion of their visit.
44. We reserve the right to remove personal belongings that are left in the lockers at the end of each day.
45. Unclaimed property shall be kept for a period of 1 week after which the management reserves the right to dispose of the items in such way it in their entire discretion deems fit. Clothing and other similar items will be disposed of after a 1-week period, however any items of value will be handed over to the police as lost items.
Member behaviour and code of conduct
46. Members and guests must treat the facilities and one another with respect; failure to comply shall constitute a serious breach of the terms of membership and could result in the loss of membership without refund or recourse.
47. We are a drug free environment and we support drug free sports. Any member found to be in violation of this code, or found to be using or promoting illegal performance enhancing drugs, will be reported to the appropriate authority. The membership will also be cancelled with immediate effect and no refund will be given
48. We reserve the right to prevent access to, or use of, the facilities by anyone deemed to be acting inappropriately or behaving in an unacceptable manner, as determined by management or based on complaints from other members.
49. As a courtesy to other members, Gym equipment should be wiped down by members after use, and all equipment returned to its correct position.
50. Any anti-social or offensive behavior will result in the member or guest being immediately evicted from the gym and your membership cancelled.
51. Our Social Media platforms are intended as a means of creating community, facilitating communications, and providing a forum for the expression of feedback. Inflammatory posts, including any content which is judged by our management at its absolute discretion to be inappropriate, may be subject to remedial action, including removal of the offending posts, blocking access, and termination of membership as a consequence of serious misconduct.
52. Good personal hygiene is mandatory, and any member who causes offence will be asked to remedy the offending problem or leave the gym and membership may be cancelled at the sole discretion of the facility management.
Facility use
53. The management accepts no responsibility for theft or damage to a member’s personal belongings kept in the lockers or otherwise for any reason whatsoever.
54. The use of mobile phones with camera features and/or and other types of visual records in changing rooms are strictly prohibited, and members are requested to ensure that they do not offend any other person when utilizing such equipment within our facility.
55. Food can only be consumed in designated areas.
56. The normal hours of operation are as indicated at reception and notice board. The management reserves the right to adjust the hours for the purpose of cleaning decorating, repairs and special private functions and holidays.
General terms
57. By visiting the Site, you represent, warrant and covenant that (a) you are at least 18 years old; (b) The customer using the website who are Minor /under the age of 18 shall not register as a members and shall not transact on or use the website.
58. Soliciting and selling private personal training sessions or merchandise of any type to any member is prohibited and may result in immediate termination of the membership concerned.
59. Desert Barbell reserves the right to use any individual or group photographs of members and or guests for press or promotional purposes.
60. Desert Barbell Sports Club has zero freelance policy. Anyone deemed to be freelancing in Desert Barbell Sports Club without prior permission, will be asked to leave the facility immidiately without refund.
61. All members must abide by the club rules of which may be amended and/or added to from time to time at the management’s discretion.
62. Failure by the management to enforce any of their respective rights at any time for any period shall not be construed as a waiver of such rights.
63. Members and/or guests are not allowed to photograph or copy any of our facilities interior designs, promotional materials, tag lines, themes or concepts. We reserve the right to proceed with legal action against any member caught distributing, sharing or supplying such contents to any third-party vendor or competitor.
64. The desertbarbell.co website may automatically produce search results that reference and/or link to third party sites throughout the World Wide Web. We have no control over these sites or the content within them. Desert Barbell does not guarantee, represent or warrant that the content contained in the sites is accurate, legal and/or inoffensive. Club Commandments
In the spirit of Strength & Unity - Members agree to abide by the Club commandments. Failure to do so may result in being asked to leave the Club without refund or recourse:
1) RESPECT THE EQUIPMENT, THE CLUB AND YOUR FELLOW LIFTERS
No dropping empty bars, no throwing plates, greet your fellow members, say hello to the newbie, minimize PDAs and leave your ego at the door.
2) TRAIN CLEAN
Clean and return equipment after use. Make use of the cubbies to keep the gym floor clear of clutter. This includes cleaning chalk from bars and benches after use with the brushes and towels provided.
3) KEEP IT ON
Always dress appropriately and keep your shirt on. Be respectful.
4) LEAVE IT AS YOU FOUND IT
We try hard to keep the Club in order so the next person can have the same great experience as you, so please put the equipment and plates back where they belong after use. Your are responsible for the equipment you use.
5) LIFTING IS A TEAM SPORT
Squat and bench sets close to failure require at least 2 spotters.
6) BE MINDFUL OF OTHERS
Don’t occupy main lifting stations for longer than needed.
7) PAY AS YOU GO
No IOU’s on retail products
8) BE A TEAM PLAYER
Support Club community events, support your fellow lifters.
